The Supreme Court sided with Royal Dutch Shell (NYSE: RDS-A ) today in the landmark Kiobel v. Royal Dutch Petroleum case dealing with alleged corporate human rights abuses in the Niger River Delta. This decision constitutes a disgraceful victory for corporate impunity. Shell shareholders would be shortsighted to celebrate, and responsible investors have the power to do what the judiciary won't.
Dismissed, but not innocent
To be clear, the Supreme Court did not find Shell innocent of the accusations against it. Those accusations are for crimes against humanity, including torture and extrajudicial executions. Rather, the court found that the case could not be resolved in U.S. courts under a federal law called the Alien Tort Statute (ATS), because Shell is a foreign company that allegedly committed acts against foreign victims on foreign soil. Never mind that Shell is listed on the New York Stock Exchange and earned almost 20% of its 2012 revenue in the United States.

The telecom market is in a state of upheaval right now. The two-player dominance of AT&T and Verizon is being challenged as smaller players combine to pose a new threat. Sprint-Nextel (NYSE: S ) recently landed a massive cash investment from Japanese network Softbank, and it also picked up data networking specialist Clearwire. T-Mobile US (NYSE: TMUS ) merged with prepaid expert MetroPCS and is using Metro's network assets to improve its own high-speed services. Combined, T-Mobile and Sprint nearly add up to a third 100-million subscriber Rolodex in the same class as Verizon and AT&T.

The downside to the U.S. telecom and entertainment service provider business is that it's rife with competition. Verizon is one of only two behemoth domestic carriers -- the other being AT&T�-- that's really able to throw its weight around with regard to wireless pricing and flexibility. That doesn't stop the little guys from trying, however, as Sprint Nextel�agreed to a big investment by Japan's SoftBank, which will give it a majority stake in Verizon in exchange for billions of dollars to build out its 4G LTE network. Similarly, T-Mobile (NYSE: TMUS ) merged with MetroPCS to give the bigger service providers a run for their money, and it's been offering no-obligation iPhone contracts to lure new customers.

Andrew Burton/Getty Images Most of us couldn't imagine life without our cable or satellite TV, high-speed Internet access and wireless communications. They've become basic utilities, and we pay handsomely for them. Yet, we aren't very satisfied with the service we get. According to the latest American Customer Satisfaction Index, customer satisfaction with subscription TV (cable, satellite and fiber optic service) and Internet service providers continues to decline. Satisfaction with pay TV fell 4.4 percent, to an ACSI score of 65 (on a 100-point scale), while ISPs -- which include many of the same companies -- dropped 3.1 percent to 63. These are the lowest scores of all 43 industries tracked by ACSI. "Customers question the value proposition of both, as consumers pay for more than they need in terms of subscription TV, and get less than they want in terms of Internet speeds and reliability," said Claes Fornell, ACSI chairman and founder. The survey finds that customers are much more dissatisfied with cable TV than with fiber-optic and satellite service. Dish Network (DISH) at 67, the lowest-scoring satellite TV company, still rates higher than the best cable company, Cox Communications, with 63. Comcast (CMCSA) (parent company of CNBC) at 60 and Time Warner Cable (TWC) with 56 have the most dissatisfied customers. ACSI Managing Director David VanAmburg noted that for the last decade or so, the price of these communications services has been rising much faster than inflation. Some households, especially people living in an apartment, now pay more for TV and Internet service each month than they do for gas and electric. Another complaint: When there is a service issue, the customer service experience isn't very good. "These are not companies that do a very good job of providing good call center customer care or good face-to-face customer care," VanAmburg said.
